The agreement between you and us when you buy something.
Who you’re buying from
SiliHack is a trading name of LADYAN UK LTD, a company registered in the United Kingdom under registration number 16192435, with its registered office at 26 Old School Close, Beckenham BR3 4PQ. These terms are issued by LADYAN UK LTD, referred to below as “we”, “us” and “our”. This website is owned and operated by us and hosted by Wix.com. We make food-grade silicone reusables, and we list detailed product information to help you decide. These terms set out the conditions on which you may access and use this website and the services we provide. By visiting the site or buying from us, you confirm that you have read, understood and agree to comply with them.
Creating an account
To use this website or receive our services you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and have the legal authority, right and freedom to enter into these terms as a binding agreement. You may not use this website or receive our services if doing so is prohibited in your country or under any law or regulation that applies to you.
Terms of sale
When buying an item you agree that you are responsible for reading the full item listing before committing to buy it, and that you enter into a legally binding contract to purchase when you commit to buy and complete the checkout payment process. We sell to customers in the United Kingdom only and can accept orders for UK delivery addresses only. The prices we charge for our products, including delivery charges, are listed on the website. We reserve the right to change our prices at any time and to correct pricing errors that may inadvertently occur. All items are inclusive of UK Value Added Tax.
Delivery
We accept orders for delivery to addresses within the United Kingdom only. We aim to dispatch within one to two working days and deliver by Royal Mail Tracked 48, typically three to five working days from dispatch. Delivery estimates are estimates rather than guarantees. Returns and refunds
For any undamaged product, return it with its included accessories and packaging within 28 days of the date you receive it, and we will refund you using your original payment method. We email you a pre-paid Royal Mail label, so returning an item costs you nothing. You are responsible for packaging the item securely. Items can only be returned unused and in their original selling condition. In the event of a dispute over the condition of a returned item, we will provide documentation by email, and our decision is final. This does not affect your statutory rights under the laws of the United Kingdom. We are unable to offer refunds, returns or exchanges on used straws for hygiene reasons. Using the products
Our products are food-grade silicone intended for food and drink. Please follow the care guidance on the packaging and on this site. Do not place them on a naked flame or a hot hob, and do not use them for anything they were not designed for.
Retention of right to change offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability, for any reason or for no reason.
Right to suspend or cancel your account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these terms or any applicable law or regulation. You may discontinue use and request to cancel your account or any services at any time.
Indemnification
You agree to indemnify and hold LADYAN UK LTD harmless from any demands, loss, liability, claims or expenses, including legal fees, made against us by any third party due to, arising out of, or in connection with your use of this website or any of the services offered on it.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. To the maximum extent permitted by applicable law, we assume no liability or responsibility for any errors, mistakes or inaccuracies of content; any personal injury or property damage of any nature resulting from your access to or use of our service; or any unauthorised access to or use of our secure servers and any personal information stored in them. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under the law of the United Kingdom.
Right to change and modify these terms
We reserve the right to modify these terms from time to time at our sole discretion, and you should therefore review this page periodically. When we change the terms in a material manner, we will notify you that material changes have been made. Your continued use of the website or our service after any such change constitutes your acceptance of the new terms. If you do not agree to these terms, or to any future version of them, do not use or continue to access the website or the service.
Promotional emails and content
Our promotional materials are only sent with your consent, and we remain compliant with the UK GDPR and the Privacy and Electronic Communications Regulations. Typically this requires you to complete the sign-up section on this website and to tick the opt-in prompt, and every marketing email carries an unsubscribe link. We will not use information gained, accessed or stored for the purposes of a transaction or general communication, such as customer service and enquiries, to facilitate promotions. Preference of law and dispute resolution
These terms, the rights and remedies provided under them, and any and all claims and disputes related to them or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in London, England. The application of the United Nations Convention on Contracts for the International Sale of Goods is hereby expressly excluded.
